Aqua Andy service terms

1. Scope of services

These terms apply to services provided by Aqua Andy (ABN 85 530 363 151), trading name registered to Andrew Peter Chilcott as a sole trader. Specifics of each job are set out in the written quote and any signed work order, which together with these terms form the agreement. NSW Fair Trading Contractor Licence 456556C (Class: Swimming Pool Repairs and Service).

2. Quotes and pricing

Quotes are valid for 30 days from the date issued. Quotes are based on the scope and site conditions described at the time. Variations to scope, materials, parts, or unforeseen site conditions may result in price adjustments. Any change to the quoted price will be confirmed with the customer before the additional work proceeds.

3. Cancellation and rescheduling

Bookings can be rescheduled at no charge with at least 24 hours notice. Cancellations or no-shows on the day of a scheduled visit may attract a callout fee equivalent to the minimum service charge. Equipment installation jobs that have already had parts ordered may incur a restocking fee if cancelled after the parts are dispatched.

4. Payment terms

Maintenance and small jobs are payable on completion via bank transfer or card. Larger installation jobs may require a deposit (typically 50%) before parts are ordered, with the balance due on completion. Australian Consumer Law guarantees apply regardless of payment terms.

5. Workmanship and warranties

Statutory consumer guarantees under the Australian Consumer Law apply and cannot be excluded. Manufacturer warranties on supplied equipment (Astron, Zodiac, BWT, Pentair, Jandy, Waterco, Aquaheat) are passed through and registered at the time of install. Warranty claims should be raised in writing to info@aquaandy.com.au.

6. Site access and safety

Customers must provide safe, unobstructed access to the pool, equipment and any required power outlets. Pets should be secured during the visit. Any known hazards (electrical issues, unstable structures, chemical storage) must be disclosed before work begins. Aqua Andy carries public liability insurance and operates within the scope of NSW Fair Trading Contractor Licence 456556C.

7. Liability

Aqua Andy's liability is limited to the cost of re-performing the relevant service or refunding the amount paid for that service, except where Australian Consumer Law mandates a higher remedy. Aqua Andy is not liable for pre-existing pool, equipment or surface defects, or for water loss caused by leaks not identified at the time of service.

8. Privacy

Aqua Andy collects and handles personal information in accordance with the Privacy Act 1988 (Cth) and the Privacy Policy. Contact info@aquaandy.com.au for any privacy enquiries.

9. Governing law

This agreement is governed by the laws of New South Wales, Australia. Any dispute will first be addressed in good faith between the parties before either party commences legal proceedings.
